After years of red tape and bureaucratic feet-dragging, Washington, Oregon, Nevada, California, Alaska, Maine, Massachusetts and Colorado have taken important steps in loosening the reigns on the sale of recreational marijuana. Colorado and Washington were the first governments to give businesses the green light to begin selling marijuana for recreational use.

Where is it legal to buy recreational marijuana?

Medical marijuana is legal in 20 states and Washington, D.C. Not surprisingly, California was the first state to legalize the sale of marijuana for medical purposes in 1996.  In 2012, Colorado and Washington were the first states to legalize the sale of marijuana for recreational use.  In 2017, Washington, Oregon, Nevada, California, Alaska, Maine, Massachusetts and Colorado are recreational states as voted for by the people.  The first recreational business licenses were granted in November and December 2013 in Colorado, and the first stores opened in January 1, 2014.  Dispensaries like eufloracolorado.com, dubbed “Apple Store of Pot”, have set examples for other dispensaries and has thrived. Who can buy it?

Anyone age 21 or older can buy recreational marijuana with a government issued photo ID. While you don’t have to be a resident of Washington or Colorado to purchase, the amount of marijuana you can purchase in a single transaction is significantly less if you are not a native of the state in which you are purchasing.

How much can I buy?

You can purchase an ounce or less of marijuana at any given time, if you are a resident of the state in which you are purchasing. If the marijuana is infused into a food product, that product must weigh one pound or less. If you’re buying marijuana in liquid form, you can buy up to 72 ounces at a time.If you are not a resident of the state in which you are purchasing the marijuana, you can purchase one-quarter of an ounce of usable marijuana.

Can I give it away?

In the state of Washington, giving away marijuana is considered the same as selling and only licenses retail businesses are granted licenses to sell. You can face felony charges for giving marijuana you purchased to someone else.  In the state of Colorado, you can give away up to one ounce of marijuana.

Where and when can I use it?

So far, state regulations on the use of marijuana mirror those laws governing the consumption of alcohol. You can’t do it in public and you can’t drive under the influence. So basically, you can consume your marijuana at home.  Businesses and government officials are discussing the possibility of opening consumption to private, members-only clubs.  However, Washington has a ban on smoking in public places, so consumers would have to use vaporizers in order to use in public.  Local and state governments will have many details to iron out as stores begin to sell marijuana in the coming days.
